Dow Chemical, a leader in specialty chemicals delivering products and solutions to markets such as electronics, water, packaging, energy, etc., has agreed to resolve the Urethanes Opt-Out case litigation. In this settlement, Dow has agreed to pay the opt-out plaintiffs $400 million, which is estimated to result in net cash payments totalling approximately $250 million. The Opt-Out litigation represents claims from customers who elected not to be class members in the previously settled Urethanes Class Action matter. The complaint was by customers who were overcharged during 1999-2003 and the opt-out cases added the 1994-98 period. However, Dow has maintained that it did not fix the polyurethane prices at any time. The investigation that concluded in 2007 did not take any action against the company.
